Elisa Benhaim

Elisa specialises in criminal law, more specifically corporate criminal law. She supportsd businesses and private individuals in various sectors, including transport, waste management and recycling. In addition, Elisa frequently handles cases for industrial companies to which the Major Accidents (Risks) Decree 1999 applies (BRZO companies).

Specialisations

  • Work-related accidents which are the subject of an investigation under Criminal or Administrative law. Elisa has extensive experience in dealing with large-scale accidents which are also investigated by the Dutch Safety Board (Onderzoeksraad voor Veiligheid).
  • Environmental criminal cases, including EWSR criminal cases, discharges and pollution incidents.
  • Fraud cases, including those involving a suspicion of swindling, forgery of documents, corruption and money laundering.
  • Traffic law, cases in which Elisa assists professional drivers of haulage companies who have been involved in an fatal or non-fatal accident.
  • Providing legal assistance to police officers. Since its inception (2015), Elisa has participated in the national pool of lawyers available to provide legal assistance to police officers, including those involved in shooting and traffic incidents.
  • Assisting for reporting punishable offences or filing a complaint against a decision made by the Public Prosecution Service not to press charges, or further charges.
  • Medical criminal law, including doctors facing criminal prosecution in relation to euthanasia.
  • BIBOB (Public Administration Probity Screening Act), experience with BIBOB cases.
  • Other criminal cases.

Work experience

Elisa joined Legaltree as a partner in 2020. Before that, she was employed as a corporate criminal lawyer at Sjöcrona van Stigt Advocaten in Rotterdam from 2009 until 2018 and as a lawyer partner with De Haas Advocaten in Rotterdam from 2018 to 2019.

Memberships & ancillary positions

  • Member of the Dutch department of the Women's White Collar Defense Association (WWCDA)
  • Presentations and training courses with undertakings and industry organisations, including transport of hazardous goods (VOTOB), chemical industries (VNCI) and transport and logistics (TLN), and assistance given by the authorities to prepare for legal proceedings following an incident/accident.

  • University of Amsterdam – Criminal law, 2007
  • Before she took up law, Elisa attended college in the United States for one year on a scholarship related to her joining the University tennis team.
